1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the Tourism Regulatory Authority (TRA) Digital Tourism Compliance Gateway ("the Platform"). The Platform is operated by the Kenya Tourism Regulatory Authority, a state corporation established under the Tourism Act, Cap. 383 of the Laws of Kenya.

By registering an account, submitting an application, or using any feature of the Platform, you agree to be bound by these Terms.

2. Eligibility and Registration

To register on the Platform you must:

All tourism businesses operating in Kenya are required to hold a valid TRA licence under the Tourism Act. Through this Platform you agree to:

You may use the Platform solely for lawful purposes in connection with your tourism business compliance obligations. You must not:

5. Data Accuracy and KRA Verification

The Platform integrates with the Kenya Revenue Authority (KRA) API to verify KRA PINs and taxpayer information. By submitting your KRA PIN you authorise TRA to query KRA systems for verification purposes.

If KRA returns information that conflicts with what you have provided, TRA may place your application on hold pending clarification.

6. Payments

Licence fees and Tourism Fund levies must be paid through the payment channels available on the Platform (M-Pesa, card, or bank transfer). TRA does not accept cash payments through this Platform. Payment receipts are generated automatically and available for download.

Overpayments are subject to the TRA refund and reversal policy. Disputed payments must be reported within 30 days of the transaction date.

7. Intellectual Property

The TRA Kenya name, logo, QR code design, and all content on this Platform are the property of the Kenya Tourism Regulatory Authority. Your licence certificate and QR code are issued for use in connection with your specific licensed enterprise only and may not be transferred or reproduced for any other purpose.

TRA may suspend or revoke your Platform access and/or licence if you:

9. Dispute Resolution

Any dispute arising from the use of this Platform or a licensing decision shall first be referred to the TRA Compliance Officer in writing. If unresolved within 21 days, the matter may be escalated to the TRA Director General, and thereafter to the Tourism Appeals Tribunal established under the Tourism Act.

10. Limitation of Liability

The Platform is provided "as is." TRA makes reasonable efforts to ensure availability but does not guarantee uninterrupted access. TRA shall not be liable for losses arising from system downtime, data entry errors by the operator, or third-party payment gateway issues.

11. Changes to These Terms

TRA may update these Terms from time to time. Continued use of the Platform after notice of changes constitutes acceptance. Material changes will be communicated via the Platform and by email to your registered address.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. The Tourism Act (Cap. 383), the Tourism (Licensing) Regulations, and the Tourism Fund Act shall prevail in the event of any conflict.
